WHAT INFORMATION IS YOUR LANDLORD ENTITLED TO AFTER YOU SIGN CONSENT TO CREDIT AND BACKGROUND CHECK?

Depending on your landlord and the forms they use for the release of information and consent that you sign, the forms often are misleading in stating which information is released.

EMPLOYER: Your employer is required to disclose the status of your employment - in other words, tell the landlord if you are employed or not. In most cases, the employer discloses the date when the employment started. No other information, such as for example your salary or hourly rate should be disclosed. However, most landlords require copies of last few pay-stubs to verify your income.

BANK: With the consent you signed, your landlord is entitled to the status of your banking relationship. In other words, the bank will disclose if you have an active bank account with them, and, in most cases, average balance in your account for the past six months. This is all your bank is required to disclose. The bank, in most cases, sends your landlord a letter confirming that you have an account with them, and that your account is active and in good standing. Your bank can only disclose this information if you request it, or after the bank receives a written request together with the consent to disclose that you signed. No specific information, such as past overdrafts, can be disclosed. However, if your bank account is currently overdraft when your bank receives the request, they can choose to report that your account is not in good standing. 

CRIMINAL HISTORY: Criminal background information is public information, and your landlord has a right for any and all information regarding crimes committed by you in the past. Most landlords do this automatically, but usually do not deny your application based on a minor offense in your history, such as for example open container or suspended driver license. However, if you are, for example, listed as a sexual predator, the landlord may be required to deny your application, based on the location of the home and other relevant facts.

CREDIT: Your landlord may request a credit report from the three major credit bureaus. That report would show any and all past and current debts and bankruptcies. If the amount of debt you own is significant compared to your income, the landlord may deny your application. However, if the application is denied based on bad credit history, your landlord is required to tell you which credit bureau reported such information so that you will have a chance to verify the correctness of the information.

PREVIOUS TENANCIES: Most landlords contact your previous landlord to find out if any problems occurred during your tenancy. Most landlords are happy to provide either a written or a verbal statement regarding a previous tenancy. When verbal, some landlords do disclose problems, such as late payments, bad condition of the home, or any other problems that occurred during your tenancy. In most cases, landlords are much more careful about disclosing information when they have to put it in writing.
